DEAR Office of the District Attorney, Family Support Division, Child Support Enforcement, Clark County, NV (Las Vegas)

This is my second open letter and I would first like to say that the issues which spawned the previous letter were eventually addressed, solutions were enacted and I applaud the Family Support Division.

The issues I am highlighting today are not so clearly under the Division's control, however, as the individuals employing and enforcing the offending policies, they are also the individuals most empowered to bring about change.

Obviously, my concerns are in regard to Child Support.  Let me start by saying that I am in no way opposed to child support and believe the assistance the DA's office provides custodial parents is usually a great asset.  How child support is defined and determined is where I am having difficulty.

 Here are the basic rules for child support for non-custodial parents:
1 child - 18% of gross income
2 children - 25% of gross income
3 - 29%, 4 - 31%, +2% for each additional.

There are monthly maximums per child based on monthly income:
0        -         4,235          621
4235     -      6351           683
6351     -      8467           747
8467     -     10585          807
10585   -     12701          870
12701   -     14816          931
14816   -     unltd            995

For a income increase of OVER $10,000 PER MONTH, the payment max goes up $374
Let me change the monthly incomes to annual incomes:

0        -      50,820          621
50820    -  76212           683   (at this point it's taking all my will to continue this chart...)
76212    - 101604          747
101604  - 127020          807  (I'm fighting not to vomit and there are 3 tiers to go!!!)
127020  - 152412          870  (I'm crying)
152412  - 177792          931  (I'm convulsing)
177792  - on up             995

The first tier goes up to $50,000 annual income?!?!?!  $50k is pretty much my marker for when I'm ballin'.  The difference in lifestyle between $20k and $30k is BIG. Between $30k and $50k is HUGE!!!  I've broke $50k a few times in my life and at those times I could give a shit if I was paying 600 per month or 750 per month.
BUT NO WORRIES!!! I WOULD HAVE TO MAKE $75K BEFORE HAVING TO PAY $750 per month.
Since the economy took a crap, my annual income has been more in the $20k-$40k (more towards 20).  When you bring in $2800 one month you're FUCKED.  first you lose about 15% in taxes (I'm being nice), so you're at 2380.  Now take out the 600 and you're at 1780. $1k for rent/mortgage.  You're at 780. Avg Elec. at about 230. You have $550.  Water/garbage/gas - 150?  We're at $400.  Cel phone & internet $100? (my cel is $250) We're at $300.  I'll just point out that at this point you:
DON'T WATCH TV.
WALK TO WORK.
IN FACT, YOU DON'T EVEN HAVE A CAR.
NO PETS.
DON'T EAT  AND DEFINITELY DON'T SMOKE!
OH YEAH, YOU LIVE ALONE AND HAVE NO CHILDREN.

...AND YOU'VE BEEN WEARING THE SAME CLOTHES FOR 5 YEARS.

$2800/mo works out to $33k per year.  That's $17,000 less than $50k.  Remember, I'm fuckin' BALLIN' at $50k.  $17,000 is the difference between losing your house and rolling in $$$$.

THE FIRST TIER IS AT $50,000!!!!
THERE ARE 7 TIERS ON THE WAY UP TO $175,000.
THESE TIERS ARE ASSURING THE DISTRIBUTION OF A $375 DIFFERENCE BETWEEN TIER 1 AND TIER 7.
SERIOUSLY?!?!?!?!?!

Who decided that someone making $150,000 per year gives a flying fuck about $375?

I'll tell you who DOES give a fuck about $375 - ALL THE PEOPLE IN TIER ONE!!!!

The basic child support rules state 25% gross monthly income if you have 2 kids (which I do).

BUT THAT'S ONLY IF YOU MAKE $5464 OR LESS PER MONTH.

From that point on up, the per child maximum limits your payments to an amount below 25%

In fact if you reach the TOP TIER, THE MOST YOU CAN PAY IS 7% OF YOUR MONTHLY INCOME.  But you sure as hell can pay less!!!

Any guesses who's making the laws around here?

I mean REALLY?  The system is 100% upside down and backwards!!!
The guy who can least afford a forced expense has to put out 25% of his income.  LEAST AFFORD ANY BILL - 25%

The guy who would still have $132,000 AFTER paying out 25% in child support is limited to paying 7% per child.  Why?!?!?  25% affects him less than ANYBODY!?!?!   FUCK!!!!  All the broke bitches barely getting by - ONE QUARTER OF YOUR NOTHING PAYCHECK.  WHAT?!?!?! (25% is for two children remember)  STILL 18% WILL WIPE OUT EVERY BROKE DUDE OUT THERE TOO.  FUUUUUUUUCCCCCKKKKK!  WTF?!?!?!

THIS IS AN EDIT - I'VE GOT THE ANSWER!!!!  HAVE THE RICH DUDES PAY THEIR 18% - GIVE THEIR KID 7% AS THEY ARE CURRENTLY ALLOCATED (THEY DON'T LOSE SHIT) AND GIVE THE 11% TO LOW INCOME CUSTODIANS IN LIEU OF THEIR BROKE EX- HAVING TO MOVE BACK IN WITH THEIR MOM.  THAT'S RIGHT, GIVE A MOTHER FUCKER A BREAK!


I'm tired of spelling this out and if you don't get it by now, I have failed and don't deserve your attention.


Judges commonly make well over $100k per year.
Do you really think they can be sensitive to the impact of $450 per month (formula for 1 child) on a person making $30k per year?

1. It is devastating.
2. Very different than supporting a child.
3. When living paycheck to paycheck or often, day to day, paying out a chunk of money is fucking hard to do.

When my children live with me, they go without nothing.  In fact, they live what I consider very privileged lives and my parents were WAY more affluent than I am - so I'm not patting myself on the back.  BUT, if you ask me to come up with a $750 payment, instead of some shoes, a Slurpee, and a Hot Wheel each day, you're gonna be disappointed.  IT'S NOT THE SAME THING.

In a Judge's eyes, $750 is a LOW payment for two children.  That's only $375 per kid!  Way below the $621 maximum.  If he wanted to, he could set my payment at $1242.  After a thousand for housing, I basically have $0.  ZERO!  But he's been so kind as to lower the payment $500.  Sweet.  $500 in monthly expenses other than rent.  I could probably pay for gas in my car.  That's ALL.

You wonder why there are so many deadbeat Dad's in the lower income brackets.  THOSE LAZY FUCKS DON'T EVEN CARE ABOUT THEIR CHILDREN.  No. If they don't disappear, they will end up homeless and unemployable due to unreasonable demands placed on them for child support.

I've had my license suspended TWICE (and it still is) due to unjust demands for child support.  Support payments the court has ordered reversed.  I'm still being hunted for fines for driving on a suspended license!!!
My insurance is going to cancel me in 3 DAYS!!!   Why? Because I didn't make child support payments while my children were living with me.
I have over $2,000 in fines hanging over my head.  Why?  Because I didn't pay my ex- child support when she and the kids were living with me. (Yes, she's that much of a bitch).

The consequences I am suffering for having done nothing wrong are immense.  AND YOU WONDER WHY LOW INCOME FATHERS ARE SO OFTEN DEADBEATS????

The very institution set up to encourage fathers to take responsibility for their children is making it IMPOSSIBLE for those fathers to do so.

IM NOT EVEN LOW INCOME,
NOR AM I DELINQUENT ON CHILD SUPPORT
AND STILL,
THE CHILD SUPPORT ENFORCEMENT OFFICE
IS DESTROYING MY LIFE.

Before some CSE agent looks up my file and says, "This guy's full of shit! Let's fuck him up!!!" Let me clarify:
Since the events I refer to in this case, there has been a new case with CSE where I haven't paid $750 per month since February.  This case is currently under review in the Supreme Court of Nevada.  I'm not paying because once I do, that money is GONE.  and I'm going to be liable for CONSIDERABLY less than I'm being assessed at this point and frankly, I have no fucking money so I can't afford to just throw away thousands of dollars to an abusive grandmother who stands between me and my children, not to mention is fucking them up (just like she did her own children).  So fuck her.  I'm waiting for the Supreme Court ruling if you don't mind...
